MEMBERSHIP AGREEMENT

Services Provided: Revolve Fitness Equipment obligations are stated further on in this present document and the undersigned Member’s equipment membership are conditioned upon (i) Member executing this Agreement and instating as designated, (ii) Member executing a Release in the form provided by Revolve Fitness Equipment, and (iii) Member, in any case, conforming with this Agreement (including, without constraint, the Rules characterized below) For purposes of the foregoing conditions, the term “member” shall include the individual mentioned below to whom the membership belongs. Conditioned on the foregoing, operating hours, as established from time to time, now and then.

Manner of Payment:

Compliance with Rules: Member shall abide by all membership and website rules and regulations settled by Revolve Fitness Equipment, which may be displayed on our website, provided in writing, or issued orally and which may be amended from time to time in the sole discretion of Revolve Fitness Equipment (collectively, “Rules”). I agree that improper or unauthorized use of the equipment or violation of the Rules may result in member suspension or cancellation at Revolve Fitness Equipment ’s discretion.

General: This Agreement represent the complete understanding between Member and Revolve Fitness Equipment. No representations, written or oral, other than those contained in this contract are authorized or binding upon Revolve Fitness Equipment. Member understands that he/she is obligated to pay the membership fee regardless of whether Member uses the equipment. Member agrees to promptly notify Revolve Fitness Equipment in writing of any changes of address, phone, and credit card information. At the end of the term of this membership contract, it shall continue in effect on a month-to-month basis unless new rates have been installed or you provide notice of cancellation to terminate this contract. In the case of credit card being cancelled, 5 days is permitted prior to processing of renewal. If no, a $49 late fee will be charged along with the other fees related to the membership. In the case of payment being declined, the member agrees to provide a successful payment within 48 hours, if no a $49 late fee will be charged. No refunds will be given for unused, partially used or prepaid months.
Extended Failure to Pay: Member promises to pay all monthly membership dues at time of monthly renewal. If member fails to reconcile their account for an extended period (30 days) Revolve Fitness Equipment has the right to cancel membership and collect equipment at their own discretion. A notice to collect will be sent after the 30-day period with a time a date for collection. If member persists to refuse return of equipment, Revolve Fitness Equipment has the right to legal action to collect equipment and unpaid dues.

YOU, THE BUYER, MAY CANCEL THIS AGREEMENT AT ANY TIME PRIOR TO MIDNIGHT OF THE FIFTH (5TH) DAY BEFORE THE PROCESSING, EXCLUDING HOLIDAYS. IF MEMBERSHIP IS CANCELED EARLIER THAN 12 MONTHS FROM MEMBERSHIP START DATE, AN $89 PICKUP FEE WILL BE INSTITUTED. TO CANCEL THIS AGREEMENT, EMAIL SUPPORT@REVOLVEFITNESSEQUIPMENT.COM A NOTICE THAT STATES YOU, THE MEMBER, ARE CANCELLING THIS AGREEMENT, OR WORDS OF SIMILAR EFFECT. OR CANCEL THROUGH YOUR USER PORTAL AT REVOLVEFITNESSEQUIPMENT.COM. SUCH NOTICE SHALL BE SENT ON OUR WEBSITE. IF THE FIFTH DAY CANCELLATION PERIOD IS EXPASSED, YOU, THE BUYER WILL BE REQUIRED TO PAY THE FULL MONTHLY MEMBERSHIP FEE AND WE WON’T HAVE THE OPTION TO OFFER ANY REFUND. NO CANCELLATION IS AN
AUTOMATIC RENEWAL AT THE BILLING DATE.

Revolve Fitness Equipment may alter its inventory, operating hours, type and quantity of equipment from time to time in its sole discretion. You are entering this agreement with your own will to rent gym equipment. Thus, Revolve Fitness Equipment claims all authority to change its routines and equipment to accommodate such evolution. I certify that I have read and understood all the terms of this agreement and consent to abide by all of the terms of this Agreement.

RELEASE FROM LIABILITY AND ASSUMPTION OF RISK (ADULT)
PLEASE READ CAREFULLY, COMPLETE, AND INITIAL BEFORE SIGNING
1) I am 18 years old of age
2) In the case of the use of the equipment by minors, I take full responsibility over assisting any minor under the age of 18.
3) I agree to pay for any damaged items received back at the full retail price (in the case of repairs, loss, stolen, etc.).
4) I hereby acknowledge that I should consult with my primary care physician before beginning any exercise program.
5) I certify that I am not aware of any medical condition which would render me unfit to participate in any exercise program and that I will inform Revolve Fitness Equipment immediately of any change in my medical condition.
6) I agree that if I experience symptoms such as shortness of breath, chest pain, unusual fatigue, dizziness or fainting, or extreme pain, whether I am under the direct supervision of my trainer, or not, I will immediately stop exercising.

I UNDERSTAND AND ACKNOWLEDGE THAT THERE ARE RISKS INHERENT IN ANY EXERCISE PROGRAM INCLUDING BUT NOT LIMITED TO HEART ATTACK, STROKE, ORTHOPEDIC INJURY, INJURIES CAUSED BY THE USE OF EXERCISE EQUIPMENT AND OTHERS. THESE INJURIES CAN OCCUR SUDDENLY AND WITHOUT WARNING, AND MAY RESULT IN DEATH. I AM VOLUNTARILY PARTICIPATING IN THIS EQUIPEMENT MEMBERSHIP PROGRAM WITH KNOWLEDGE OF THE DANGERS INVOLVED, AND I HEREBY AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH AND VERIFY THIS STATEMENT BY PLACING MY INITIALS BELOW. FOR AND IN CONSIDERATION OF PERMITTING ME TO PARTICIPATE IN THE PROGRAM, I, FOR MYSELF, HEREBY RELEASE AND FOREVER DISCHARGE REVOLVE FITNESS EQUIPMENT AND ITS DIRECTORS, OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, ATTORNEYS, INSURERS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, “REVOLVE FITNESS EQUIPMENT PARTIES”), FOR ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, RIGHTS, ACTIONS, CAUSES OF ACTION, EXPENSES, AND SUITS OF ANY KIND WHATSOEVER, FORESEEN OR UNFORESEEN, FOR PERSONAL INJURY, WRONGFUL DEATH, DAMAGE TO PROPERTY, OR OTHERWISE RESULTING FROM MY PARTICIPATION IN THE PROGRAM AND/OR THE ACTS OF OMISSIONS OF ANY OF REVOLVE FITNESS EQUIPMENT PARTIES, INCLUDING ANY AND ALL NEGLIGENT ACTS, WHETHER ACTIVE OR PASSIVE, IRRESPECTIVE OR WHETHER SUCH INJURIES, DEATH, OR DAMAGES OCCURE DURING TRAINING OR THEREAFTER.
